Port Blair, Jan 11: In yet another case under POCSO Act, 2012, on 10th January 2022, the Hon’ble Special Judge (POCSO) Shri. Raja Chatterjee had pronounced judgment by which accused namely Shyam Chand Halder, Son of Late. Binay Halder, resident of Shaheed Dweep has been convicted for a term of 20 years of rigorous imprisonment together with fine of Rs. 5,000/- in default of payment of such fine further 6 months of imprisonment.

On 08.05.2020, victim’s mother reported about the incident wherein she stated that she was residing with her husband and two daughters in a rented house at Shaheed Dweep. In the month of August, 2019 accused Shyam Chand Halder came from Kolkata and started to stay in his son-in-law’s house, the victim and her mother were the tenants of his son-in-law. On day the victim’s mother noticed that the elder daughter who was aged about 4½ years old was not in the corridor and when she searched for her and when she entered the house of the Shyam Chand Halder, she found the accused sexually assaulting her daughter, as a result the victim sustained injury.

Seeing the act, she shouted at him and then the accused ran away from that place. Hence, a case was registered upon the complaint of the victim’s mother before PS Shaheed Dweep under POCSO Act being FIR No. 05 of 2020. The prosecution examined all witnesses including the victim, who narrated the entire incident and after conclusion of trial, the Hon’ble Court found the accused person guilty of the offence under Section 6 of POCSO Act.

The victim was also been awarded with compensation to the tune of Rs. 2.00 Lakh by the Hon’ble Court which will be paid by the State. The trial was conducted by Ms. A.S.Zinu, Special Public Prosecutor on behalf of the State.
