Sri Vijaya Puram, Oct. 4: The Hon’ble Special Judge, Shri. Niyaz Alam on 26th September 2024 convicted one accused person, resident of Bimblitan Village, Port Blair, South Andaman in a sexual assault case committed by him against his minor daughter then aged about 12 years.
It is averred that on 15.06.2022 when victim girl’s mother had gone out for work, the accused locked the room and committed sexual assault upon his daughter. Meanwhile his sons who were playing outside came back and knocked the room. Being frightened with the knocking, the accused left the daughter and she apprised about the incident to her brothers and mother. Then the matter was brought to notice of PS Pahargaon who registered case against the accused person under Section 376 of Indian Penal Code (IPC) read with Section 3(b)/5(l)(n)/9(n) of POCSO Act and the investigation was taken up by IO Seema Bhomick.
The prosecution examined 14 witnesses and the Hon’ble Court after conducting trial found the accused person guilty of the offence and sentenced him to suffer 03 year’s rigorous imprisonment under Section 7/8 of POCSO Act and ordered him to pay a fine of Rs. 10,000/- in default of payment of such fine further rigorous imprisonment of 03 Months. The case was conducted for and on behalf of the State by Special Public Prosecutor Miss. A.S Zinu.
