Port Blair, Jan 31: Ministry of Environment, Forest and Climate Change (MoEF&CC) vide notification no G.S.R 593(E) dated July 21, 2022 has notified the Hazardous and Other Wastes (Management& Trans boundary Movement) Amendment Rules, 2022 for effective utilization and management of Waste tyres through the Extended Producer Responsibility (EPR) regime as per guideline given at Schedule-IX of the Amended Rules.

An online Waste tyre EPR Portal has been developed by Central Pollution Control Board for registration of Producers, Recyclers and Retreaders as defined under the said rules.

Producer: ‘Producer’ means any person or entity who, - (i) manufactures and sells new tyre domestically; or (ii) sells domestically under its own brand, new tyre manufactured by other manufacturers or suppliers; or (iii) sells imported new tyre; or (iv) imports vehicles fitted with new tyres; or (v) automobile manufacturers importing new tyre for use in new vehicles sold domestically; or (vi) imports waste tyre;

Recycler: ‘Recycler’ means any person or entity engaged in the process of recycling;

Retreading: ‘Retreading’ means process of renewal of tread and side wall rubber of a worn out tyre having a good structural quality;

These entities are not allowed to carry out Business without EPR registration and the portal is presently registering Producers and Recyclers of Waste Tyre. 

The Registration in EPR portal is made on the basis of valid Consent to Operate (CTO) issued under the Water &Air Act by the State Pollution Control Board/ Pollution Control Committee. Hence, Tyre waste Producer/Recycler/Retreading units in Andaman and Nicobar Islands have been requested to apply for the following statutory requirements from Andaman Pollution Control Committee as per Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 within 20 days for getting themselves registered in centralized EPR portal:

Consent to Establish/Operate under Section 25 and 26 of the Water (Prevention & Control of Pollution) Act, 1974 as amended from time to time.

Consent to Establish/Operate under Section 21 of the Air (Prevention & Control of Pollution) Act 1981 as amended from time to time.

Authorisation under Hazardous Waste Management Rules 2016.

Application for Consent may be filed through Online Consent Management and Monitoring System (OCMMS) developed by ANPCC. (Link-www.anocmms.nic.in).
