Port Blair, Aug 23: The CPI (M) has demanded to appoint the waitlisted candidates against the unfilled vacancies of MTS on the basis of the select list and wait-list published by the A&N Administration on 2.3.2019. Shri D. Ayyappan, Secretary, CPI (M) A & N State Organising Committee met the Secretary (Perl) at Secretariat, Port Blair today (23.8.2022) and submitted a letter on this issue.

Even though about 96 candidates did not join the posts against which they were appointed or left the posts after joining within 6 months, the waitlisted candidates were not considered for appointment against such unfilled vacancies. Shri Ayyappan told the Secretary (Perl) that the affected candidates approached the Administration at various levels several times but they were not appointed against the vacancy arose due to the non-joining of selected candidates and resignation of those already joined. 

Aggrieved over the inaction and non-action on the part of the authorities concerned, some of the candidates approached the Central Administrative Tribunal, Calcutta Bench which disposed of the application with a direction to the Administration to consider their representation within a period of 12 weeks. The Administration vide Order No.1971 dated 28th September, 2020 rejected the claim of the applicants. Thereafter, being aggrieved over the rejection of their claim, these applicants again approached the Hon’ble CAT which, after examining the matter on merit on 29.3.2022 observed that “In view of the legal propositions enumerated above, having noted that even wait-listed  candidates  have a right to be considered for appointment in the event candidates from the main list does not join…..” and  ordered among other things  “…and pass appropriate orders for their appointment from the waiting list, keeping suitable number of vacancies aside for the present wait listed candidates.”  The CAT had further ordered that the exercise be completed within a period of two months from the date of receipt of a copy of the order.    

Secretary, CPI (M) stated in the letter that though the aforesaid order was passed by the Hon’ble CAT nearly five months back, the Administration has not issued any order appointing the wait-listed candidates against the posts of MTS, etc.  thereby violating the solemn order of the Hon’ble Tribunal.  It is regrettable that the unemployed local youths are forced to run from pillar to post to get their legally-entitled job due to the adamant attitude on the part of authorities concerned, Shri Ayyappan wrote in his letter. Being over-aged, most of these candidates have no chance of appearing in any competitive examination for a government job.  CPI (M) requested the Administration to honour the court order and render justice to the aggrieved youths.
