Port Blair, Oct. 14: The Hon’ble Special Judge Shri Raja Chatterjee on 13th October 2022 convicted one accused persons namely Mithun Sikder, resident of Durgapur Village, Diglipur in a sexual assault case committed by him against a minor girl then aged 11 years.

It is averred that on 01.11.2016 the victim girl had been to the tuition centre and the tuition teacher i.e. the accused herein was alone in the centre and no one else except the victim was present. The accused thereafter made the victim sit on his lap and started touching her body inappropriately and also touched her private part with bad intention. The victim out of fear came out of the centre and called her father. Then the matter was brought to notice of PS Diglipur who registered a case against the accused person under Section 354 of Indian Penal Code (IPC) read with Section 9(m) & 10 of POCSO Act.

The prosecution examined 09 witnesses and the Hon’ble Court after conducting trial found the accused person guilty of the offence and sentenced him to suffer 5 (five) years rigorous imprisonment under Section 10 of POCSO Act and ordered him to pay a fine of Rs. 10,000/- in default of payment of such fine further rigorous imprisonment of 3 (five) months. The Special Court also awarded a sum of Rs. 1,00,000/- (Rupees One Lakh only) as compensation for rehabilitation of the victim girl. The case was conducted for and on behalf of the State by Special Public Prosecutor Miss. A.S Zinu.
