Port Blair, Sept. 5: The Hon’ble Special Judge Shri. Bhawani Shankar Sharma, at Port Blair on 05th September 2023 convicted one accused persons namely Manojit Joydhar, resident of Lal Pahad, Chouldhari Village, Ferrargunj Tehsil in a sexual assault case committed by him against a minor girl then aged 11 years.
It is averred that on 30.05.2018, when the victim boarded the Auto-rickshaw of accused who was the driver of the said Auto-rickshaw and at some place the Auto-rickshaw stopped, he finding the girl alone left the driving and entered the back seat and touched her inappropriately and expressed his intention to remain with her at night. He was then found under the influence of liquor.
The incident was brought to the notice of the mother who informed the said incident to concern PS i.e. PS Ograbraj who registered a case against the accused person under Section 7 & 8 of POCSO Act read with Section 354 of Indian Penal Code (IPC) and the investigation was taken by SI Benedict.
The prosecution examined 06 witnesses and the Hon’ble Court after conducting trial found the accused person guilty of the offence and sentenced him to suffer 4 (four) years rigorous imprisonment under Section 7/8 of POCSO Act and ordered him to pay a fine of Rs. 25,000/- in default of payment of such fine further rigorous imprisonment of 6 (six) months. The case was conducted for and on behalf of the State by Special Public Prosecutor Miss. A.S. Zinu.
