Whereas, the Cluster Head & Vice President, HDFC Bank Ltd., MG Road, Junglighat, intimated that borrower Mr. Sudip Chakraborty, Proprietor of Chakraborty Hospital had availed loan facilities under the Health Care Infrastructure Finance and Health Care Equipment Loan schemes from HDFC Bank by executing the necessary loan and security documents for the landed properties bearing Sy. No.91/1/2 area 0.03 ha classified as house site and 0.03 ha classified as Commercial and Sy. No.91/1/1/2/1 area 0.01 ha classified as Commercial situated at Pahargaon village under Sri Vijaya Puram Tehsil. Upon default in repayment of the outstanding dues and classification of the account as a Non-Performing Asset (NPA), the Bank initiated proceedings under the SARFAESI Act, 2002, in accordance with the guidelines of the Reserve Bank of India.
Accordingly, a notice under Section 13(2) of the SARFAESI Act was issued to the borrower on 14th February 2023. After the expiry of the statutory notice period, the borrower, Mr. Sudip Chakraborty, voluntarily submitted a letter surrendering the mortgaged property. Accordingly, the Authorized Officer of the Bank has taken over the physical possession of the said property and completed the required formalities under the SARFAESI Act.
Additionally, informed that the borrower has given his written consent for the sale of the property with the declaration that he shall not raise any objection for further proceedings.
In light of the above, HDFC Bank has requested to accord necessary permission under section 159 (9) of Andaman and Nicobar Islands Land Revenue and Land Reforms Regulation 1966 read with rule 168(A) of Andaman and Nicobar Islands Land Revenue and Land Reforms Regulation 1968 to proceed with the sale of the mortgaged property through private/public auction, or e-auction, and to facilitate registration of the property in favour of the successful purchaser.
Now, therefore this public notice is issued for the information of Shri Sudip Chakraborty, Borrower and any other interested parties with the request to file their claims or objections, if any, with regard to grant of sale permission in respect of the landed properties as mentioned above within 07 days from the date of issue of this public notice to the office of the undersigned. And in the event of there is no receipt of claims or objections within the stipulated period, the permission to sale the scheduled property shall be accorded in accordance to the SARFAESI ACT and under the permissible provisions of Andaman and Nicobar Islands Land Revenue and Land Reforms Regulation.
