Hutbay, July 14: On 09th July 2026, Shri Umesh Singh Sharma, Hon’ble Special Judge (POCSO), Sri Vijaya Puram delivered a judgment in a heinous rape case. Accused Paritosh Sarkar S/o Late Baddar Sarkar R/o R K Pur, Little Andaman was convicted for committing rape to a minor girl in the year 2012.
The matter was reported to Police Station Hutbay, leading to the registration of FIR No. 109/2012 dated 04.11.2012 under Section 376/506 IPC against the step father of the victim girl. The case was investigated by then SI Aditya Narayan, PS Hutbay.
The case was trial before the Hon’ble Court of the Additional Sessions Judge-cum-Special Court (POCSO), South Andaman, which convicted accused Paritosh Sarkar U/s 376(1)/506 IPC. The convict preferred an appeal before the Hon’ble High Court at Calcutta, Circuit Bench at Port Blair by the Hon’ble High Court upheld the conviction and remanded the matter to the trial court. On 09.07.2026, the Hon’ble Court after hearing the convict in person, sentenced him to 10 years rigorous imprisonment with a fine of ₹50,000 under Section 376(1) IPC and 2 years rigorous imprisonment with a fine of ₹10,000 under Section 506 IPC. The court further directed that the fine amount, upon deposit be paid to the victim towards her rehabilitation.
The Hon’ble Court, considering the facts and circumstances of the case, directed payment of compensation of ₹6,00,000/- (Rupees Six Lakhs only) to the victim under the Compensation Scheme for Women Victims/Survivors of Sexual Assault and Other Crimes, 2018 (NALSA) for her rehabilitation, education, and future welfare.
