A&N Traffic Police Issues Clarification on the Use of Tinted Films / Nets in Vehicles

Sri Vijaya Puram, July 11: In light of growing concerns over compliance with vehicle safety and visibility norms, A&N Traffic Police issues this advisory to vehicle owners and stakeholders in the automobile industry, reaffirming the legal position regarding the use of tinted glass in motor vehicles based on the Hon’ble Supreme Court’s judgment in Avishek Goenka vs. Union of India and the relevant provisions of the Central Motor Vehicles Rules (CMVR), 1989.

In its landmark judgment dated 27 April 2012 in Writ Petition (Civil) No. 265 of 2011, the Hon’ble Supreme Court in terms of Rule 100(2), of the Central Motor Vehicles Rules, “prohibited the use of black films of any Visual Light Transmission (VLT) percentage or any other material upon the safety glasses, windscreens (front and rear) and side glasses of all vehicles.

The manufacturer of the vehicle may manufacture the vehicles with tinted glasses which have VLT of safety glasses windscreen (front and rear) as 70 per cent VLT and side glasses as 50 per cent VLT, respectively. No black film or any other material can be pasted on the windscreens and side glasses of a vehicle.”

The Hon’ble Court further directed to challan such vehicles for violating the Rules and thereupon also to remove the black films from the offending vehicles.

A&N Traffic Police urges all vehicle owners, automobile service providers and the public to strictly comply with these guidelines in the interest of road safety and effective law enforcement.

General public is also encouraged to report traffic violations by sending clear photograph/short videos of violation containing clear registration no. of vehicle with date, time and place of offence on the official Whatsapp No. 9531892228 for prompt action against the violators.
